Tribunal's reasoningThe respondent did not attend the hearing on 29 February 2024. In its ET3 presented on 30 November 2023, the respondent admitted at section 6.1 that the claimant was entitled to unpaid salary of £15,752.52 (covering May to August 2023) and a further £878.80 representing a retention bonus payable in June 2023 (equivalent to one week's salary). The Tribunal ordered the respondent to pay the total sum of £16,631.32 in settlement of the original complaints of unlawful deduction from wages.
The claimant accepted that the Tribunal did not have jurisdiction to determine complaints in respect of unpaid pension contributions or of interest (payable only under the Employment Tribunals (Interest) Order 1990). Those two complaints were dismissed upon withdrawal by the claimant.
The claimant's application dated 12 December 2023 to amend his claim to update losses arising since the original claim form was allowed in the absence of objection from the respondent. That amended complaint will be subject to case management orders within the Note of Preliminary Hearing for those claimants in the Jimenez multiple dated 22 February 2024.
