On that basis, the tribunal ordered the respondent to pay £12,928.92 in settlement of the claimant’s original complaints of unlawful deduction from wages.
The judgment also dealt with a separate complaint about unpaid pension contributions. The claimant accepted that the tribunal did not have jurisdiction to determine that complaint, and it was dismissed upon withdrawal by the claimant.
On 4 January 2024 the claimant’s application to amend his claim so as to update losses arising since presentation of the original claim form was allowed because there was no objection from the respondent and the respondent did not attend. The judgment states that this amended complaint would be subject to case management orders in accordance with the Note of Preliminary Hearing for the Jimenez multiple dated 22 February 2024.
