The judgment further provided that if the RPS did not make payment for any reason other than a failure by the claimant to use best endeavours or to do what the RPS required, and subject to any legal challenge she should first make if there were reasonable prospects of success, the redundancy payment would remain due from the respondents. In that event it was to be paid at £100 per month, with the first instalment due no later than 30 days after the date on which the respondents were due to make the final payment to the claimant's husband in case 2410516/2019. If any instalment was late, interest would accrue at 4% per annum on the unpaid amount.
The claimant's claims for unfair dismissal, notice pay, holiday pay, and failure to provide a written statement of terms and conditions of employment were withdrawn, and the parties agreed that those claims should be dismissed.
