Tribunal's reasoningThe tribunal recorded that Mr Bouse had made no claim to the Redundancy Service for payment from the National Insurance Fund under sections 166 or 182 of the Employment Rights Act 1996. His claim was therefore dismissed.
For the other claimants, the tribunal found that they did not have a contract of service with Postworth Ltd t/a Skyblue under section 230 of the Employment Rights Act 1996. It therefore found that they had not shown they had contracts of employment or were employees of Postworth Ltd t/a Skyblue at the material time.
On that basis, the tribunal concluded that the claimants were not entitled to payments under sections 166, 167 or 182 of the Employment Rights Act 1996. The claims against the Secretary of State for Business and Trade failed and were dismissed.
