Miss M Knowles v Manone Medical Limited — 2019

This judgment concerns a preliminary application by Miss M Knowles to add Mr David Marland as a further respondent. Employment Judge Robinson refused the application. The tribunal recorded that the full hearing was listed to start on 18 November 2019 for three days.

In refusing the application, the tribunal noted that the respondent's solicitor had agreed that Mr Marland would give evidence and that the respondent company would represent him, so any wrongdoing by him would be covered by the company. The tribunal accepted that Mr Marland was involved in the allegations made by the claimant, but said that if there were liability for his actions the company would deal with it through any compensation ordered. The claimant's point that the company might go into liquidation and dissolve was not treated as a sufficient reason to add him as a party.
