Key findings
Tribunal's reasoningThe tribunal held that the claimant's claims for unpaid wages and holiday pay succeeded. It found unlawful deductions from wages between 5 December 2019 and 4 October 2020 in the sum of £1,008.57, and a further unlawful deduction of £132.79 arising from furlough pay between April 2020 and September 2020 because the claimant's hourly rate of £8.50 was below the National Minimum Wage of £8.72, so his furlough pay should have been increased by 18 pence an hour.
The tribunal also found that between 5 December 2019 and 4 October 2020 the claimant accrued holiday entitlement which he did not take and was not paid for at the end of employment. It awarded £1,175.46 for that holiday pay claim, based on the respondent's calculated average of a 28.5 hour working week over the relevant period. The total sum ordered to be paid immediately was £2,316.82.
