Mr G Iacob v Mr Oprea-Aurelian Iscru (trading as Artisan Sash Joinery) — 2024

Mr G Iacob was employed by Mr Oprea-Aurelian Iscru, trading as Artisan Sash Joinery, from 15 January 2021 until his effective date of termination on 13 October 2023. The claimant gave five weeks' notice, worked the first three weeks and then took two weeks' annual leave. The tribunal recorded that the respondent did not respond to the claim, did not make any contact with the tribunal, and did not attend the hearing.

The tribunal found the complaint of unauthorised deductions from wages well-founded. It held that the respondent had made unauthorised deductions from the claimant's wages in the period between 15 September 2023 and 13 October 2023. The reasons note that the respondent continued to notify HMRC of wages being paid beyond the EDT, had not provided a P45, and had not paid any sum in respect of the wages due for the last five weeks of the claimant's employment.

The claimant's gross weekly wage was recorded as £461.53 before tax and National Insurance. On that basis, and because no payment had been made for the final five weeks, the tribunal held that he was entitled to the full amount claimed. The respondent was ordered to pay £2,307.65, described as the total of the gross sums deducted, with the claimant responsible for any tax or National Insurance due.
