Tribunal's reasoningThe claim form was presented on 31 January 2020 and served on the Respondent at its registered office, but no response was received. The Tribunal therefore proceeded under Rule 21 of the Employment Tribunals Rules of Procedure 2013. A telephone preliminary hearing took place on 14 April 2020 because of the Covid-19 pandemic, and the Tribunal obtained further information from the Claimant in order to determine liability and remedy on the available material.
The Claimant, Ms Kiran Shafiq, had worked for the Respondent as a beauty therapist for just over five years, from 1 August 2014 to 24 August 2019, at £8.21 per hour for 12 hours per week. The salon closed on 24 August 2019, and the Tribunal found that her employment ended by reason of redundancy. It also found that she had 5 years' service, was entitled to 5 weeks' notice, and was given no notice of termination.
On remedy, the Tribunal found that the redundancy payment claim was well founded and awarded £492.60. It also upheld the claim for unlawful deductions in respect of arrears of pay and ordered payment of £394.08 gross, and upheld the wrongful dismissal claim for notice pay in the sum of £492.60. The Tribunal further accepted that the Claimant had accrued untaken leave, calculated that 25.5 hours was due on the material before it, and awarded £209.35 gross under regulation 30(1)(b) for failure to make a payment in lieu of leave under regulation 14(2).
