Tribunal's reasoningMs K Wales brought an ET1 against Secret Garden Café Hull Ltd on 18 March 2025. The respondent did not present a response by the deadline. The tribunal recorded that Ms Wales had worked 24 hours per week in the respondent's cafe at £11.40 an hour, was paid monthly, and that her employment ended in June 2024 without notice.
The tribunal accepted that Ms Wales had not been paid for the shifts she worked in May 2024 or for the shifts worked in June up to the termination date. It found that the unpaid May wages totalled £1,289.08 gross, due on 31 May 2024, and that the unpaid June wages totalled £657.80 gross, due on termination or by 30 June 2024. Because no payment was made and there was no contractual or statutory authority for the non-payment, the tribunal held that there had been an unlawful deduction of wages and awarded £1,946.88 gross.
The tribunal also found that Ms Wales was entitled to one week's notice but none was given. Applying rule 22 of the Tribunal Rules of Procedure 2024 on the material available, the judge was satisfied that judgment could properly be issued without a hearing. The tribunal therefore awarded damages for breach of contract in the sum of £266, calculated on a net basis.
