Tribunal's reasoningThe claimant, Mr Mohammed Imtyazuddin, worked for Securicorp NE Ltd as a door supervisor from the end of October 2022 until mid-January 2023, when he resigned. The agreed hourly rate was £9.75. He was paid for October and November 2022, although with delay, but he was not paid for any of the wages he said were due for December 2022 or January 2023.
At the hearing, the claimant provided shift allocations and timesheets showing 591 hours worked in December 2022 and 170.5 hours worked in January 2023. He also produced an ACAS email dated 2 February 2023 recording that the respondent had confirmed the December invoice was correct and should be paid at the end of February or early March. The respondent did not appear at the hearing and did not submit a response to the tribunal claim.
The tribunal held that the unlawful deduction from wages claim succeeded. It awarded £5,762.25 for December 2022, calculated as 591 hours at £9.75 per hour, and £1,662.38 for January 2023, calculated as 170.5 hours at £9.75 per hour.
