Tribunal's reasoningMiss J Wilde worked for GM Packaging (UK) Ltd as a sales administrator from 6 August 2018. She resigned by letter dated 19 February 2020, giving notice to expire on 13 March 2020. The tribunal rejected the respondent’s case that her last working day was 28 February 2020 and found that the employment contract continued until 13 March 2020.
The tribunal found that Ms Wilde was ready, able and willing to work during the notice period, including after 3 February 2020, but was not permitted to return to work. It also found that she was paid up to and including 28 February 2020, but received no pay for the 10 working days between 2 March and 13 March 2020. That non-payment was held to be an unauthorised deduction from wages contrary to section 13 of the Employment Rights Act 1996, and the complaint was held to be well-founded under sections 23 and 24 of that Act.
For remedy, the tribunal found that Ms Wilde’s annual gross salary was £19,500, giving a gross daily rate of £75. It calculated the unpaid amount for the 10 working days of the notice period as £750 and ordered GM Packaging (UK) Ltd to pay that sum to the claimant. The judgment did not record any separate award for interest or any other head of loss.
