No appearance or v Respondent — 2023

The claimant was employed by the respondent as a Coroner and Claims Officer from 25 June 2018 until his dismissal with effect from 19 January 2023. In case 2501609/2021 he alleged detriments for having made protected disclosures contrary to section 47B ERA 1996. In case 2502444/2022 he alleged automatic unfair dismissal under section 103A ERA 1996 or, alternatively, ordinary unfair dismissal under sections 94 and 98 ERA 1996.

The claimant did not attend the five-day final hearing and had not given advance notice or responded to the tribunal's attempts to contact him. The tribunal recorded that he had repeatedly failed to engage, had not complied with orders requiring him to confirm whether he would attend or seek a postponement, and had previously been debarred from advancing evidence in relation to the second claim.

After considering rule 47 of the Employment Tribunals Rules of Procedure 2013, the available papers, the respondent's wish for the claims to be heard in public, and the overriding objective, Employment Judge Loy dismissed both claims because the claimant failed to attend or be represented. No substantive findings were made on the merits of either claim and no remedy was awarded.
