Mr Callum Swain v Magnetic North Group Limited — 2023

At a hearing held at Newcastle CFCTC by CVP on 10 November 2023, Employment Judge Johnson heard the claimant, Mr Callum Swain, in person. The respondent, Magnetic North Group Limited, did not attend and no response had been received; the judgment notes that the company was in liquidation.

The tribunal held that the complaint of unauthorised deductions from wages was well-founded. The tribunal also held that the holiday pay complaint was well-founded. It found that the respondent had made an unauthorised deduction by failing to pay for holidays accrued but not taken when the claimant's employment ended, and ordered payment of £444.23 in respect of accrued holiday pay. The claimant was again responsible for any tax or national insurance due on that payment.
