Tribunal's reasoningThe claimant, Miss C Kent, started work for the respondents on 1 September 2022 as a Business Development Executive and her employment ended on 31 October 2022. The tribunal found that the respondents told the claimant and her colleagues at 5 pm on the Friday of the last week in October that their employment was being terminated, with no prior notice. Her contract entitled her to one week’s notice.
The tribunal also found that the claimant’s monthly salary was £2,250, equivalent to £27,000 per year, and that she did not receive any salary for October 2022 despite working the whole month. On that basis, the tribunal upheld the claim for unpaid wages and awarded £2,250 gross for October pay.
As to holiday entitlement, the tribunal found that the claimant was entitled to 5.6 weeks’ holiday per year, including bank holidays, and that she had worked 61 days in September and October 2022. It calculated her accrued entitlement on termination as 0.93576 weeks and rounded that up to one week. The tribunal therefore upheld the claim for accrued holiday pay and awarded £519.23 gross.
The tribunal changed the first respondent’s name to Save Your Money Group Limited and, because it was not clear which respondent was the claimant’s employer and neither respondent participated in the proceedings, it made judgment against both respondents jointly and severally for the sums due. The notice pay claim was also upheld and awarded at £519.23 gross, bringing the total award to £3,288.46 gross, subject to lawful deductions for tax and national insurance if applicable.
