Mr G Treharne v Plant Services (Gateshead) Limited — 2019

Mr G Treharne complained of unauthorised deductions from wages against Plant Services (Gateshead) Limited. At the hearing on 27 December 2018, the tribunal recorded that the claimant said his pay structure had changed during 2018, including salary and dividend elements, and that after his suspension on 3 September 2018 he had been paid less than he said was due. The respondent accepted that no written statement of particulars of employment had ever been provided, and the tribunal also noted that the respondent's documentary material had been served late.

The tribunal said it had insufficient evidence to reach a meaningful final judgment on the wider dispute because the respondent had failed to provide appropriate documentation and its witness statement was wholly inadequate. It was nevertheless satisfied that there had been an unauthorised deduction from wages in at least the amount of £2,482, calculated as the difference between £6,240 said to be due from suspension to dismissal and £3,758 actually paid.

The tribunal ordered the respondent to pay £2,482 net to the claimant, with the respondent responsible for any income tax and national insurance contributions on that sum. It postponed the balance of the claimant's unauthorised deduction complaints to a later date, to be relisted only if the claimant notified the tribunal by 31 January 2019 that he wished to pursue them.
