Mrs J Wilkinson v The Co-operative Group Limited Heard: Remotely (by video link) — 2021

This was a remedy hearing held remotely by video link on 7, 8 and 9 April 2021 before Employment Judge S Shore and lay members Mr R Greig and Mrs J Maughan. The tribunal unanimously ordered the respondent to pay the claimant compensation following her successful disability discrimination claim.

The tribunal awarded £10,000 for injury to feelings. It calculated interest on that award at 8% per annum from the date of the act to the remedy hearing, agreed to be 693 days, at a daily rate of £2.19, producing £1,517.67.

For loss of earnings, the tribunal awarded nine weeks after the end of the claimant’s notice period, with four weeks paid at half pay to reflect a phased return and the remaining five weeks at full pay. It calculated the loss at £255.86 for the first four weeks and £639.65 for the remaining five weeks, totalling £895.51.

Interest on lost earnings was awarded at 8% per annum from the midpoint between the date of the act and the remedy hearing, agreed to be 347 days, producing £69.40. The total payable was £12,482.58, to be paid within 28 days of the date the judgment was sent to the parties.
