Tribunal's reasoningOn 27 June 2022 the tribunal warned Mr Chapwanya that it was considering striking out his claim because it had not been actively pursued and because he had not complied with the order dated 13 June 2022. He was told to send objections or ask for a hearing by 4 July 2022, but he did neither. On 21 July 2022 the tribunal struck out the claim on the basis that it had not been actively pursued and that strike out was proportionate.
After the judgment was sent to the parties, the claimant said he had not received the correspondence and wanted to "appeal" the decision. Employment Judge Adkinson treated that as an application for reconsideration and invited a substantive response by 3 August 2022 so the claimant could address the strike-out warning. The claimant did not reply.
The judge found that the correspondence had been sent to the postal and email addresses the claimant had provided, that he had not produced proof of non-receipt, and that he had given no explanation for why the tribunal's earlier conclusion was wrong or why strike out was disproportionate. The application for reconsideration was therefore dismissed because there was no reasonable prospect of the judgment being varied or set aside. The judgment records no monetary award.
