Tribunal's reasoningThe tribunal dealt only with the claimant's unfair dismissal complaint. It recorded that Ms R Joshi had been employed by Jdrm Dentalcare Ltd for less than two years, and that section 108 of the Employment Rights Act 1996 requires at least two years' service to bring an unfair dismissal complaint.
Because the claimant did not have the necessary qualifying service, the tribunal found that she was not entitled to bring the complaint. It also recorded that, despite being given the opportunity to do so, the claimant failed to give an acceptable reason why the complaint should not be struck out.
The judgment therefore struck out the unfair dismissal complaint. It added that the claimant's other complaints were not affected by this decision.
