The tribunal found that the second contract provided for payment at £14.36 gross per hour for hours worked, and rejected the respondent's later contention that the rate should be treated as £13.46 after deducting breaks. The tribunal accepted the claimant's records showing that he worked 20 hours per week and noted that the respondent produced no documentary evidence to the contrary.
On the wages calculation, the tribunal used the agreed total of 456.61 hours worked and multiplied that by £14.36 to reach £6,794.14 gross due. It found that the claimant had actually been paid £6,909.10 gross, so there had been an overpayment of £114.96 on the wages element. For holiday pay, the tribunal used the Government ready reckoner and found an entitlement to 32.8 hours, valued at £758.20. It then credited payment for two days' holiday, calculated as £215.40, and also took account of the £114.96 wage overpayment.
The tribunal therefore awarded £427.85 in respect of unpaid wages and holiday pay. The hearing was a remote open preliminary hearing before Employment Judge P Britton sitting alone.
