Ms K Stephens v Arnold Home Care Limited — 2022

The case was heard on 2 November 2022 at Tribunals Hearing Centre, Nottingham, before Employment Judge Adkinson sitting alone. The respondent did not attend, had not presented a response, and was barred from taking part in the proceedings without permission under rule 21. The tribunal therefore heard from Counsel for the claimant and considered the evidence presented to it.

The tribunal declared that the respondent had made unauthorised deductions from the claimant’s wages. It ordered payment of £1,384.84 gross in respect of wages owed but not paid, and £5,110.76 gross in respect of pension contributions owed but not paid. It also found that holiday pay due to the claimant had not been paid and ordered £276.97 gross.

The tribunal further found that the claimant had been constructively unfairly dismissed. On that claim it awarded a basic award of £2,176, compensation for consequential loss of earnings of £17,152.42, and £500 for loss of statutory rights.
