Tribunal's reasoningThe claimant, Mr E Hudson, presented his claim after early conciliation, saying that on termination of employment on 24 April 2021 he had not been paid the week in hand worked in the first week of employment in January 2021 and had not been paid accrued holiday pay. The respondent’s response said only that all sums due had been paid, but it did not comply with the Tribunal’s order for a full response and did not attend the hearing. The Tribunal proceeded in the respondent’s absence after being satisfied that notice of the hearing had been sent.
Mr Hudson gave oral evidence, produced a schedule of loss and payslips, and his evidence was unchallenged. The Tribunal accepted his evidence that the sums claimed were due and had not been paid. It found that the failure to pay wages amounted to unauthorised deductions under section 13 of the Employment Rights Act 1996.
The Tribunal also found that the failure to pay holiday pay was a breach of the Working Time Regulations 1998. It ordered payment of £900 for unauthorised deductions and £1,125 for holiday pay. The judgment states that the total amount to be paid to the claimant was £1,925, which does not mathematically match the two individual amounts recorded in the judgment text.
