At the preliminary hearing on 15 October 2020, Employment Judge Camp held that the second claimant, Ms Wellings, had presented her claim outside the time limits in sections 48(3) and 111(2) of the Employment Rights Act 1996. The tribunal therefore found that her claim failed and dismissed it. The judgment records that reasons for this decision were given orally.

For the first claimant, Ms Kelly, the respondent applied to strike out part of her claim under rule 37(1)(a) or, alternatively, for a deposit order under rule 39. The tribunal rejected that application. Written reasons for the ruling on Ms Kelly's claim were requested by the respondent and were to be provided later. No monetary award was made in this decision.
