The tribunal found that naming Jamie Dluzewski, the dismissing officer, rather than the employer was a minor error for the purposes of the Early Conciliation and claim form rules. It relied on the fact that the work address matched the employer's address, there was no ambiguity as to who the employer was, and the employer understood that the claim was intended to be brought against it.
The judge also concluded that it would not be in the interests of justice to reject the claim. The claimant had acted in person when presenting the claim, the application to correct the respondent's name was made promptly, and rejecting the claim would deprive the claimant of the opportunity to pursue it while the employer was able to understand and respond to the case.
