Key findings
Tribunal's reasoningThe claim was determined under rule 21 of the Employment Tribunals Rules of Procedure 2013 because the respondent failed to present a valid response on time. The Employment Judge therefore entered judgment on the papers and made findings on the claims advanced by Mr C White against Touch EE Ltd.
The tribunal found that the respondent had made unauthorised deductions from wages in respect of three weeks' pay between 1 and 20 August 2021. It awarded Mr White £1,437.69 net for that claim, calculated as three weeks at £479.23.
The tribunal also found that Mr White had been dismissed without notice in breach of contract and in breach of his statutory notice entitlement of three weeks. Damages for that breach of contract claim were assessed at £1,437.69 net. In addition, the tribunal found that he was dismissed by reason of redundancy and was entitled to a redundancy payment of £1,632, stated to be three weeks' gross pay capped at £544 a week.
Finally, the tribunal found that the respondent had failed to pay the claimant's holiday entitlement and awarded £1,246 net in holiday pay, calculated as 2.6 weeks, or 13 working days, at £479.23 a week. The judgment recorded a total amount due of £5,753.38.
