Tribunal's reasoningThe tribunal found that Ms K Dillon was unfairly dismissed by Lincolnshire County Couriers Ltd. It awarded £7,811.26 in respect of that claim, made up of a basic award of £2,736.00 and a compensatory award of £3,513.01. The compensatory award was said to include loss of earnings, loss of employer pension contribution and a notional award for loss of statutory rights, and the tribunal applied a 25% uplift under s.207A of the Trade Union and Labour Relations (Consolidation) Act 1992.
The tribunal noted that the compensatory award did not cover lost earnings during the notional five-week notice period, which was dealt with separately. It then found that the claimant was dismissed in breach of contract in respect of notice and ordered damages of £2,280, being £1,824.00 plus the same 25% uplift under the 1992 Act.
On the unlawful deductions claim, the tribunal said that, insofar as the complaint concerned money deducted from wages for pension contributions that had not been paid into the relevant pension fund, it was not a matter within the employment tribunal's jurisdiction to determine. That aspect was to be referred to the Pensions Regulator.
