Tribunal's reasoningBy a letter dated 30 December 2020, the Tribunal noted that the respondent was in administration and that, under the Insolvency Act 1986 schedule B1 paragraph 43(6), no legal proceedings could be instituted or continued without permission of the Court or administrator. The case was therefore stayed for six months pending the administration ending, the administrator consenting, or the Court granting permission for it to proceed.
On 13 August 2022 the Tribunal asked the claimant to provide an update by 19 August 2022, but no response was received. A strike out warning was then sent inviting the claimant to give written reasons or request a hearing by 23 September 2022, but again no representations were received. The Tribunal found that the claimant had failed to make representations as to why the claim should not be struck out on the ground that it had not been actively pursued, and the claim was struck out.
