Tribunal's reasoningMs Aslan was a mortgage broker for Intra Private Finance Ltd. After a video meeting in which she considered the owner of the respondent to have acted in an unacceptable way, she resigned by email on 18 September 2023 and gave one month’s notice. The respondent placed her on garden leave and disconnected her from its systems. On 28 September 2023 the owner emailed that she was summarily dismissed, alleging that she had been contacting clients during garden leave; Ms Aslan denied that allegation.
The judgment records claims for unfair dismissal, breach of contract, holiday pay and wages. The tribunal did not determine those claims on the merits. It found that the three-month time limit expired on 27 December 2023, that Ms Aslan did not apply for an Acas early conciliation certificate until 9 January 2024, and that the certificate was issued on 24 January 2024 before the claim was presented on 31 January 2024. The tribunal noted that if she had applied for early conciliation in mid-December, the claim would have been in time, but that was not what happened.
The tribunal applied the test that time can only be extended if it was not reasonably practicable to present the claim in time and, if so, if it was then presented within a further reasonable period. It found that it was possible for Ms Aslan to issue the claim in time, and that being very busy with another job and family matters did not make it not reasonably practicable to do so. The tribunal also said that an Acas early conciliation application takes about five minutes and that she knew before the limitation period expired that she needed one to start a claim.
Because it was reasonably practicable to present the claim in time, the tribunal dismissed all of the claims for the same reason.
