Mrs K Janusz v ABC Distribution Limited — 2023

The case was heard on 15 August 2023 at East London Hearing Centre by CVP before Employment Judge B Beyzade. The claimant, Mrs K Janusz, appeared in person with support from her daughter. The tribunal upheld the claimant's claim for unauthorised deductions from wages in relation to arrears of pay for the period 1 November 2022 to 31 December 2022 and ordered payment of £1,972.66, subject to any required deductions for tax and national insurance if remitted to HMRC. It also upheld her separate claim for unauthorised deductions from wages in relation to holiday pay for the period 1 April 2022 to 31 December 2022 and ordered £478.14 on the same basis.

The tribunal further upheld the claimant's breach of contract claim for notice pay arising on the termination of her employment on 31 December 2022, awarding £1,372 subject to any required deductions for tax and national insurance if remitted to HMRC. It also found that the claimant was dismissed by reason of redundancy and held that she was entitled to a redundancy payment of £2,058 gross, calculated as 6 weeks at £343 gross weekly pay. No discrimination, whistleblowing, or unfair dismissal findings were recorded in the judgment.
