Tribunal's reasoningOn 5 July 2021, Employment Judge Crosfill set out the history of the case and ordered the claimant to provide further information about his unfair dismissal and redundancy payment claims by 31 August 2021. He also required an application to amend the claim form if the claimant wanted the discrimination claims to be considered, because ticking boxes on the form was not enough to confer jurisdiction.
At the remote hearing on 6 October 2021 before Employment Judge Shulman, the claimant said he had not received the earlier summary, but the Tribunal checked that it had been emailed on 5 August 2021 to the address he confirmed as his own, and he received a further copy during the hearing. He confirmed that he had attended the 5 July hearing. The Tribunal found that he had not served the required information on the respondent and had not made any amendment application.
The Tribunal found repeated non-compliance with the case management order and struck out the unfair dismissal and redundancy payment claims under Rule 37 on the basis of non-compliance and/or no reasonable prospect of success. It said there was no need to decide a deposit order or to identify the issues for a final hearing. It also recorded that there was no jurisdiction to adjudicate the discrimination claims. The Tribunal noted that the claimant would likely have benefited from representation and had not appreciated that the respondent needed to know the case it had to meet.
