Mrs Nasima Sultana v Redspot Care Limited — 2026

The claimant, Mrs Nasima Sultana, brought a claim against Redspot Care Limited for unauthorised deductions from wages in respect of arrears of pay for April, May, June, July, September and October 2024. The Final Hearing took place at the East London Hearing Centre by Cloud Video Platform on 17 March 2026 before Employment Judge B Beyzade. The claimant appeared in person, supported by her son Mr Amman Nawaz; the respondent did not attend and was not represented.

The Tribunal was satisfied that the respondent had been served with the Notice of Hearing and had not contacted the Tribunal. After waiting in excess of 10 minutes past the scheduled start time, and on the claimant's application made at the Bar, the Tribunal determined to proceed in the respondent's absence under Rule 47 of the Employment Tribunal Procedure Rules 2024 (as amended).

The Tribunal held that the claim for unauthorised deductions from wages succeeded and ordered the respondent to pay the claimant the sum of £3,340.37, subject to any required deductions for tax and national insurance, provided the respondent remits any such amount to HMRC and accounts to the claimant for any such payment. Reasons were given orally; written reasons will not be provided unless requested within 14 days.
