Tribunal's reasoningThe Tribunal allowed amendment applications by the first, second and third claimants so that their claims included protective award claims. The fourth claimant had already presented a protective award claim. The Tribunal proceeded with four outstanding protective award claims and sat judge-alone because it considered there were no disputed factual issues for which non-legal members would add significant value.
The Tribunal found that all four claimants worked at the First Respondent's Springwood Drive premises, which constituted an establishment for the purposes of the 1992 Act. On 17 May 2024 the First Respondent made the claimants redundant immediately after going into voluntary liquidation, gave no warning, did not consult, did not invite employees to appoint or elect representatives, and provided no advance information about the proposed redundancies. The Tribunal accepted evidence that more than 20 and fewer than 100 employees were made redundant that day.
