Mr J Reid v The Alchemist — 2024

Mr J Reid did not attend the full merits hearing listed on 13 February 2024. The tribunal recorded that he had not provided a telephone number on his ET1, that staff telephoned the last number available from the respondent and left a voicemail, and that staff also emailed him asking him to contact the tribunal. No response was received.

The tribunal also noted that the claimant had not responded to a strike out warning about the unfair dismissal claim sent on 23 October 2023, had not complied with case management orders sent on 15 November 2023, and had not replied to the respondent's application to postpone the hearing or to later correspondence seeking clarification of the amounts claimed. The tribunal said the remaining scope of the case was unclear, including the amounts said to be owed.

Having made practicable enquiries about the absence, the tribunal decided it was proportionate to dismiss the claims and that postponement was not appropriate because there was no evidence that the claimant intended to progress the case. The judgment therefore dismissed the claims under rule 47 and made no merits findings or monetary award.
