At a hearing on 22 October 2020 before Employment Judge A Ross sitting with Mrs M Legg and Dr L Rylah, the parties agreed that a second appeal would consider whether the Claimant satisfied the medical disability retirement criteria as at that date, based on his medical history. They also agreed that there would be no further appeal or reconsideration of the same medical evidence, that the Claimant would attend any medical practitioner he wished to provide medical evidence as soon as practicable, and that he would use reasonable endeavours to produce any additional medical report within 14 days and in any event within 42 days.
