Mr J Mayanja v Praxis Community Project — 2019

Mr J Mayanja did not attend the final hearing at East London Hearing Centre on 7 November 2019. The tribunal noted that he had been told the time and place of the hearing, had queried whether the case had been transferred to Manchester, and had already been served with the case management order refusing that application. The tribunal decided under rule 47 of Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 to proceed in his absence and considered his witness statement together with evidence from the Respondent's witnesses.

After doing so, the tribunal dismissed the Claimant's claims under the Equality Act 2010. The judgment does not break down separate reasons for each protected characteristic, but the official listing identifies the case as involving race and sex discrimination claims. No compensatory or injury-to-feelings award was made to the Claimant.

On the Respondent's application for costs, the tribunal found that the Claimant had conducted the proceedings unreasonably by continuing with a claim that had no reasonable prospects of success after being served with all of the Respondent's evidence and being warned that costs would be sought if he continued. The tribunal also found that he had deliberately or recklessly failed to attend the final hearing.

The Claimant was ordered to pay the Respondent £1,009.90 in solicitor's costs and £850 in Counsel's fees, making a total costs order of £1,859.90.
