Tribunal's reasoningThe Claimant brought complaints of pregnancy discrimination under section 18 Equality Act 2010. The tribunal found that after returning to work with fit note recommendations, she was sent home by the Head Housekeeper at Citadines Hotel on 10 October 2019, and accepted her evidence that comments made at the time referred to her pregnancy. The tribunal concluded that this was unfavourable treatment because of pregnancy.
The tribunal dismissed the other pregnancy discrimination complaints. It found that the Claimant was sent home from Holiday Inn Express on 29 October 2019 because she had not followed the sickness absence procedure and her shift had been covered, not because of pregnancy or pregnancy-related illness. It also found that the allegations of shouting, over-criticism, failure to adjust duties, being forced to perform unsuitable work, and being threatened with dismissal were not proved on the balance of probabilities or were not because of pregnancy.
No remedy was determined in this judgment. The tribunal stated that a remedy hearing would proceed, subject to the parties considering settlement.
