On 12 October 2021 the Tribunal warned that the claim might be struck out because it had not been actively pursued and invited Mr Kahher to make written representations if he objected. He did not make representations. Employment Judge Massarella therefore struck out the claim on 10 November 2021, and the hearing listed for 16 December 2021 would not take place.
