The tribunal recorded that on 29 November 2023 the claimant had been made subject to an Unless Order requiring him to exchange witness statements with the respondents by 4:00pm on Monday 4 December 2023, failing which his entire claim would be struck out. The claimant did not comply with that order, and the tribunal therefore struck out the claims.
The tribunal added that, in any event, because the claimant failed to attend the hearing, it would have dismissed the claims under Rule 47 of the Tribunal’s Rules of Procedure 2013 had strike out not already applied. The hearing fixed for 7 and 8 December 2023 was therefore not proceeded with.
