The tribunal had written to the claimant on 4 November 2021 and 14 February 2022 giving him an opportunity to make representations or request a hearing on whether the claim should be struck out for lack of qualifying service. Although the claimant replied by email on 22 February 2022, the judge found that nothing in that response suggested the claim fell within any exception to the two-year qualifying period. The tribunal therefore concluded that the claim had no reasonable prospect of success and struck it out under rule 37(1)(a).
