Tribunal's reasoningMr R Pickering presented claims of wrongful dismissal and unpaid wages on 4 September 2020. The Tribunal recorded that the employment ended on 16 March 2020, when the respondent told employees, including the claimant, that due to the Covid-19 lockdown it could not continue to pay them and that they should sign on. Ms Gipson also sent the claimant a P45.
The Tribunal found that the primary time limit for ACAS Early Conciliation expired on 15 June 2020. Early Conciliation did not begin until 31 July 2020, and the claim was presented about five and a half months after dismissal. The claimant did not attend the hearing and did not put forward any reason why it had not been reasonably practicable to present the claims in time.
On that basis, the Tribunal held that both claims were presented outside the statutory time limits, declined to extend time, and concluded that it had no jurisdiction to hear them. All claims were dismissed.
