Tribunal's reasoningAt Reading by CVP on 9 May 2023, before Employment Judge Manley with Ms C Baggs and Mr F Wright, the tribunal heard the claimant in person and recorded no attendance for the respondent, Mr Paul Scowen trading as The Cleanologists. It held that Ms K Gilbert's complaints of direct pregnancy discrimination, automatically unfair dismissal and unlawful deduction of wages succeeded.
The tribunal dealt with the financial losses for the discrimination and dismissal together. It used gross weekly pay of £290.30, net weekly pay of £274.54 and a net daily rate of £54.90 to calculate 18 weeks' loss of earnings to the start of maternity leave, holiday accrued over that period, six weeks of SMP at 90% of gross weekly pay, and 33 weeks of SMP at £151.97. It then deducted 39 weeks of maternity allowance, leaving a subtotal of £5,945.49, which was increased by 10% because the respondent failed to follow the ACAS Code of Practice on disciplinary procedures, and then by 8% interest from the mid-point of the discrimination. The resulting figure on that head was £7,183.53.
The tribunal also made an injury to feelings award of £25,000. It increased that sum by 10% to £27,500 and then added 8% interest from the date of discrimination, producing £32,918. Separately, it awarded £465 for unlawful deduction of wages. The total sum ordered to be paid to the claimant was £40,566.53.
