Mr P Breedon v Jewson Limited Heard: Norwich — 2022

Mr Breedon brought claims for disability discrimination, unfair dismissal, breach of contract and holiday pay. The respondent did not attend the hearing and no valid response had been received by the tribunal by the response deadline. The tribunal recorded that the claim had been served by correctly addressed correspondence and that the respondent had not replied to any of the tribunal's subsequent correspondence.

On that basis, Employment Judge M Warren held that Mr Breedon was entitled to judgment as to liability on all four claims. The judgment did not set out findings on the underlying factual merits of each claim; it proceeded because the respondent had not entered a valid response and had not engaged with the proceedings.

Remedy was not determined on 5 August 2022. The tribunal noted that the respondent should have an opportunity to be heard on remedy and that it would be unfair to decide compensation without advance notice to the respondent. The remedy hearing was therefore postponed to 7 November 2022, with directions for the judgment and documents to be sent to the respondent's trading address and registered office.
