In Person For the v Gala Entertainments Ltd — 2020

Ms Abbi Skipper brought claims that she had not been provided with itemised pay statements during her employment with Gala Entertainments Ltd. The respondent did not present a response by 23 March 2020, no default judgment had been issued, and no representative or written representations were before the tribunal at the final hearing on 21 September 2020.

The tribunal found that the claimant worked for the respondent as bar staff from 31 August 2019 until she resigned on 7 December 2019, at a rate of £9 per hour. It found that she was paid correctly in September 2019, but that in October 2019 she worked 77 hours and was entitled to £693 gross, while only £618 was paid. In November 2019 she worked 56 hours and was entitled to £504, while £360 was paid into her bank account by Mr Shwain Pitigala.

Employment Judge Bedeau was satisfied that the respondent had failed to provide itemised pay statements, and made a declaration to that effect. The tribunal stated the particulars that should have appeared in the October and November 2019 pay statements, including that no deductions were to be made for national insurance contributions or income tax.

The tribunal also declared that there had been unauthorised deductions from wages. It found deductions of £75 in October 2019 and £144 in November 2019, and ordered the respondent to pay the claimant £219 gross.
