Mr P Matthews v Dennis Bozier Ltd — 2021

This was a Rule 21 judgment determined on the documents without a hearing. The claimant presented a valid claim on 8 March 2020. The respondent filed a response saying the claim was not defended. The claimant later clarified in correspondence that he only wished to pursue redundancy pay and holiday pay.

The tribunal accepted from the claim form that the claimant had been dismissed by reason of redundancy and that his statutory redundancy payment had been correctly calculated at £7,637.50. It therefore made an award for that amount. The tribunal also accepted that the claimant was owed holiday entitlement and ordered the respondent to pay £780.

The claimant had also raised notice pay and what he described as loss of consultation pay. In later correspondence he unequivocally withdrew any other complaints, including the notice pay point and any complaint that dismissal occurred without a contractually required procedure. The judgment records that there was no unfair dismissal complaint in the claim form, and says that if there had been, that would also have been withdrawn. The hearing listed for 23 July 2021 was cancelled.
