Tribunal's reasoningAt the start of the hearing, Regional Employment Judge Foxwell explained that the Claimant did not have sufficient qualifying service to bring an ordinary unfair dismissal claim, and that no grounds of automatic unfair dismissal were disclosed on the claim form. The tribunal also explained that damages for breach of contract were limited to pay and benefits during the contractual notice period, which in this case was one week.
The Respondent, through Mrs Sheahan, accepted that from the disclosed payslips it did not appear that the Claimant had been paid in lieu of notice. After discussion, the parties agreed that the damages payable for the notice period were £480, including tips. The tribunal entered judgment accordingly on the breach of contract claim.
