Ms G Moldovan worked for The Coffee Pot Ltd from 19 September 2020 to 19 February 2021 under a contract for 20 hours per week at £8.72 per hour. The tribunal found that she had received her full pay for September 2020, but in October 2020 she worked 47 hours and was paid only £331, leaving a shortfall of £78.84. It also found that, although she was on furlough in November 2020 and understood the respondent to have received £514 in furlough pay on her behalf, she was paid only £500, leaving a further shortfall of £14.

The tribunal accepted that the claimant was not available for work in December 2020 or on 1 to 20 January 2021. It found that she was available for work from 2 to 31 January 2021 but was not allocated work, and awarded 30 hours’ pay at £8.72 per hour, amounting to £261.60. It further found that she was available for work from 1 to 19 February 2021, when she was dismissed, and awarded 60 hours’ pay at £8.72 per hour, amounting to £523.20.

The tribunal also found that the claimant was not paid in lieu of one week’s notice and awarded 20 hours’ pay at £8.72 per hour, amounting to £174.40. It accepted her calculation of holiday entitlement as 50 hours, valued at £436, and awarded that sum. The total net award was £1,488.04.

The tribunal said it was not concerned with the claimant’s additional financial allegations that the respondent failed to account for tax or national insurance, or that it failed to operate furlough entitlement honestly; it noted that the former may be a matter for HMRC. The respondent did not attend and no response was presented.
