Employment Judge Allen heard the matter remotely on the papers and recorded that the claimant last worked a shift for Poolside Manor Ltd on 29 July 2019, with an additional fixed-term graphic design contract ending on 30 September 2019. The claim form was filed on 19 March 2020, after ACAS notification on 20 January 2020 and certification on 20 February 2020.

The tribunal held that the statutory time limit expired on the last day of December 2019. Because the ET1 was presented after that date, the tribunal found the claim was out of time and that it did not have jurisdiction to hear it. The judgment therefore dismissed the claim without determining the merits.

The respondent's application for costs against the claimant was refused because there was insufficient information about the claimant's means to make an award.
