Tribunal's reasoningThe tribunal consolidated six files brought by three claimants against G and G Wholesale Bakers and Bakery Organics (UK) Limited. It found that Bakery Organics (UK) Limited acquired the assets and business of G and G Wholesale Bakers and continued trading from the same premises from 1 December 2017, so the employment contracts of the three claimants transferred under TUPE. The tribunal also found that the claimants were dismissed on 28 August 2018 when the operation was closed and the stock and machinery were removed.
On that basis, the tribunal held that liability lay with Bakery Organics (UK) Limited and that each claimant was entitled to a redundancy payment and 12 weeks' notice pay under their contracts of employment. It awarded Yvonne Barton £2,772 redundancy pay and £1,512 notice pay, Martin Chisholm £11,592 redundancy pay and £4,800 notice pay, and Rachel L Thomas £1,764 redundancy pay and £1,512 notice pay.
