Tribunal's reasoningThe tribunal, sitting alone, rejected all complaints of direct disability discrimination and all complaints of indirect disability discrimination. It also found that only some of the section 15 Equality Act 2010 disability discrimination complaints succeeded: those were the requirements that the Claimant sign and return the Marketing Campaign Manager contract by 10 February 2023, the refusal to defer or hold a further meeting on 8 February 2023, and the decision to choose 10 February 2023 as the dismissal date rather than a later effective date of termination.
The tribunal said that all other section 15 disability discrimination complaints failed. It also found a breach of the duty to make reasonable adjustments. The PCP identified at paragraph 28.1.3 of the list of issues was that employee health benefits ended on termination and the Respondent could dismiss with immediate effect by making payment in lieu of notice; the tribunal held that a reasonable adjustment would have been to dismiss the Claimant with notice.
The Claimant also succeeded in her unfair dismissal claim and her breach of contract claim. The judgment does not record any remedy figure because the case was listed for a separate remedy hearing on 4 and 5 December 2025.
