Tribunal's reasoningThe Tribunal considered whether the Claimant was a disabled person at the material times, from 6 March to 7 April 2022. It noted shortcomings in the Claimant's impact statement and the legibility of the medical evidence, but accepted that the medical records and the Claimant's evidence showed ongoing symptoms following a patella tendon rupture repair in 2015.
The Tribunal found that the Claimant had a physical impairment affecting his left knee. The impairment caused pain and discomfort after walking or standing for more than five minutes, created particular difficulty with stairs, and carried a real risk of the knee buckling and causing a fall.
Applying the Equality Act 2010 disability definition, the Tribunal concluded that the adverse effects on walking, standing and using stairs were more than minor or trivial and were long-term. It held that the Claimant was a disabled person at the material times.
