Tribunal's reasoningThe claimant had previously brought a claim in the London Central Employment Tribunal as part of group litigation by Just Eat delivery drivers concerning employment status, holiday pay and other payments. That earlier claim had been withdrawn by his then representatives, but no judgment formally dismissing it had yet been sent to the parties.
The tribunal found that the Watford claim was much the same as the earlier London claim. It held that the differences relied on by the claimant concerned evidence rather than different complaints, and that some additional matters raised in the Watford claim were outside the tribunal's jurisdiction.
The tribunal concluded that the claimant should not be permitted to avoid the reconsideration process in the other tribunal region by bringing the same claim again. The claims were struck out in their entirety under Rule 38(1)(b) of the Employment Tribunal Procedure Rules 2024.
